Pixelrush is a product of Kleiderer Studios, LLC ("Company," "we," "us," or "our"). This Privacy Policy describes how we collect, use, disclose, and safeguard information when you interact with our websites, applications, and related services (collectively, the "Services").

1. Information We Collect

Information you provide

  • Account information. The email address you provide when creating an account.
  • Support and other communications. If you contact us, we receive the content of your message and any information you choose to include.

Payment information

  • Payments are processed by a third-party payment processor. We do not store your payment card details. We receive limited transaction metadata such as your email address, the product purchased, and a transaction identifier.

License and device information

  • When you claim or release a license, we record a device identifier and device name to bind the license to a specific device, together with license-management metadata such as the product or tier you acquired and the timing and history of your license claims, releases, and validations.

Diagnostic and usage telemetry

We use a third-party diagnostic and observability service to help us detect, diagnose, and fix issues with the Services. Telemetry transmitted to that service may include information about errors and crashes, basic system performance, aggregated interaction events relating to the operation of the Services, a device or installation identifier and (if you are signed in) your user identifier and email address, and your IP address and user-agent string.

Automatically collected information

  • Server logs. Our servers automatically receive and may log standard request information such as IP address, user-agent string, referrer, and timestamp.
  • Update checks. Our applications may periodically contact our update distribution endpoint to check for new releases. These requests include your IP address, user-agent string, and the version requested.
  • External font services. Our website loads fonts from third-party font delivery services. These services may receive your IP address and user-agent string when fonts are loaded.

2. Local Operation of Our Software

For products that operate locally on your device, the data and content you create with the software remain on your device and are not transmitted to us, except for features you explicitly invoke that require transmission. Aggregated, non-content metadata about your use of the Services may be included in diagnostic telemetry as described above. The handling of content and telemetry for any specific product is described in the License-Specific Terms for that product.

3. How We Use Information

We use the information we collect to:

  • Provide, maintain, and improve the Services;
  • Process purchases, manage and validate licenses, and prevent license abuse;
  • Send transactional communications (for example, purchase confirmations, license notifications, and security alerts);
  • Respond to your inquiries and provide support;
  • Detect, diagnose, and fix software defects, monitor performance, and understand how the Services are used in aggregate;
  • Enforce our Terms of Service and protect against fraud, abuse, and security risks; and
  • Comply with applicable legal obligations.

4. Legal Bases for Processing

Where the GDPR or equivalent laws apply, we rely on the following legal bases:

  • Contract. Processing necessary to provide the Services and fulfill our contract with you, including account creation, license management, and billing.
  • Legitimate interests. Processing necessary for our legitimate interests in operating, securing, and improving the Services, including diagnostic telemetry, fraud prevention, and aggregate analytics, where those interests are not overridden by your rights.
  • Legal obligation. Processing necessary to comply with applicable laws, regulations, and lawful requests from public authorities.
  • Consent. Where required by law, processing based on your consent, which you may withdraw at any time.

5. How We Share Information

We share personal information only with the following categories of recipients and only to the extent necessary for the purposes described in this Privacy Policy:

  • Service providers and sub-processors. Trusted third parties that provide payment processing, transactional email delivery, diagnostic and observability services, font delivery, update distribution, and infrastructure hosting on our behalf.
  • Professional advisors. Lawyers, auditors, accountants, bankers, and insurers, where reasonably necessary.
  • Legal and regulatory authorities. Where required by law, regulation, or legal process, or where we have a good-faith belief that disclosure is necessary to protect our rights, your safety, or the safety of others.
  • Successors in interest. In connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of our assets, subject to appropriate confidentiality protections.

We do not "sell" or "share" your personal information as those terms are defined under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the "CCPA").

6. International Data Transfers

We are based in the United States and our service providers are located in the United States and other jurisdictions. If you access the Services from outside the United States, your information will be transferred to, processed, and stored in the United States or other jurisdictions that may have data protection laws different from those of your jurisdiction. Where personal information is transferred from the European Economic Area, the United Kingdom, or Switzerland to a country that has not received an adequacy decision, we and our service providers rely on recognized transfer mechanisms such as the European Commission's Standard Contractual Clauses or the UK International Data Transfer Agreement to protect that information.

7. Data Retention

We retain personal information only for as long as necessary for the purposes described in this Privacy Policy and to comply with our legal, tax, accounting, and dispute-resolution obligations. When personal information is no longer needed, we delete or anonymize it.

8. Security

We implement reasonable administrative, technical, and organizational measures designed to protect personal information from unauthorized access, use, alteration, or disclosure. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

9. Your Rights

Depending on your jurisdiction, you may have some or all of the following rights with respect to your personal information:

  • The right of access to personal information we hold about you;
  • The right to rectify inaccurate or incomplete personal information;
  • The right to erase your personal information, subject to applicable exceptions;
  • The right to restrict or object to certain processing;
  • The right to data portability;
  • The right to withdraw consent where processing is based on consent; and
  • The right to lodge a complaint with a supervisory authority in your jurisdiction. In the European Economic Area, you may contact your national data protection authority.

10. California Privacy Notice

This section provides additional disclosures required by the CCPA for California residents.

Categories of personal information collected

In the preceding twelve months, we have collected the following CCPA categories of personal information:

  • Identifiers — such as email address, account identifier, device identifier, device name, and IP address.
  • Commercial information — records of products acquired and license grants.
  • Internet or other electronic network activity information — such as information about your interaction with the Services, including diagnostic telemetry.
  • Geolocation data — coarse geolocation derived from IP address.
  • Inferences — limited aggregate inferences drawn from your interaction with the Services for the purpose of improving them.

Sources, purposes, and recipients

We collect this information directly from you, automatically through your use of the Services, and from our service providers. We use it for the purposes described in Section 3 ("How We Use Information") and disclose it to the categories of recipients described in Section 5 ("How We Share Information").

"Sale" or "sharing" of personal information

We do not "sell" or "share" personal information as those terms are defined under the CCPA, and we have not done so in the preceding twelve months. We do not have actual knowledge that we sell or share the personal information of consumers under the age of 16.

California rights

If you are a California resident, you have the following rights under the CCPA:

  • Right to know the categories and specific pieces of personal information we have collected about you, the categories of sources, the purposes of collection, and the categories of recipients;
  • Right to delete personal information we have collected from you, subject to applicable exceptions;
  • Right to correct inaccurate personal information we maintain about you;
  • Right to opt out of the sale or sharing of personal information; and
  • Right to non-discrimination for the exercise of your CCPA rights.

11. Children's Privacy

The Services are not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us at support@pixelrush.app and we will take appropriate steps to delete it.

12. Cookies and Local Storage

We use cookies and local storage that are strictly necessary to operate the Services, including for authentication, session management, and to support diagnostic features. Our website does not respond to "Do Not Track" browser signals because no consistent industry standard exists for interpreting them.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. Notice of any change is given by posting the updated Privacy Policy with a new "Last updated" date at the top of this page. The updated Privacy Policy takes effect on the date posted, except where a later effective date is expressly stated. You are responsible for periodically reviewing this Privacy Policy. Your continued use of the Services after the updated Privacy Policy takes effect constitutes your acceptance of the changes.
